how big of a hit would I take by selling with 5k miles on the car?

I've always heard you lose $5k of value the day you drive a new car off the lot. Could I sell the car at $5k below msrp with 5k miles on it? I have the $800 tire insurance policy, $800 3M front end film, $400 huper optik window film, and the $400 CF rear spoiler. I wouldn't be looking for a quick money losing sale. I could list it at a fair price and park it until it sells.

If the intermittent comfort access issue doesn't get resolved I'll list the car for sale on here. It's not worth the aggrevation to go back and forth with the dealership. I have an appointment at the dealership in a couple weeks so we'll see what happens.

Not many people would pay msrp these days so that computation doesnt work out. Try $1000 over invoice as your starting number, then take $5000 off that. Then you might have a chance.

$5k off list MIGHT sell it, but you never know. leftover 08s were going for several $k off to start. 5k miles should knock at least several $k more off. That's not exactly delivery mileage. as for the other mods, kiss your $ goodbye because no one will pay for those. it's like a dealership trying to charge money for rustproofing. you dont NEED it, just like you don't NEED window film. sorry, but that's reality there.

As nice as the 1er is, I think you'll need to take a little more off, because you've got a fair list of options on your car, and it's an '08. Try about 7K off and it ought to sell very quickly.

BTW, are you selling it simply because of a comfort access issue?

I'm not selling it yet.. but the comfort access not working properly sounds like a minor issue until you have to deal with it every day. If you offer an option on a car it should work EVERY time.. just as it does on my father's corvette.

If you are having issues with your car why don’t you follow the lemon law and you will loose very little. I had a Tacoma truck that had TPMS issues, a separated dash and a door they could not align ( I swore the cab was tweaked) and after four visits to the dealer for each problem I filled out the paperwork, let the dealer try one more time which they did not fix the issues. I went to arbitration and they gave me a new truck, I ended up paying $300 for a new truck. I think you can even get your money back if you don’t want another BMW. If you go the lemon law route you will only loose a little they deduct for mileage. BTW you don’t need multiple issues to do the lemon law, for me it was a home run hit with three issues they could not fix. I made a really nice presentation showing all the issues and steps to resolve it with documentation which impressed the arbitration board and showed I did my homework. Lemon law is a little different in some states so you need to look at the lemon law for your state.

Wouldn't comfort access work properly if you removed the window tint? Isn't that the issue with Comfort Access and cars with Metallic tinted windows?

In Virginia, it is not necessary that the drivability of the vehicle be affected to qualify as a lemon. However, the defect or condition must be one that "significantly impairs the use, market value, or safety of the motor vehicle." It might be hard to prove that a defective comfort access system qualifies.

As for sales taxes, they are considered "collateral charges," along with "license fees, registration fees, title fees, finance charges and interest, transportation charges, dealer preparation charges or any other charges for service contracts, undercoating, rust proofing or installed options, not recoverable from a third party." The point is, whatever "hit" you take does not include any of these charges.

There is, as has been noted above, a "reasonable allowance for use," which is defined as one-half the IRS mileage rate. Damage and wear and tear beyond normal use would also be deducted.

Again, this is Virginia.

Try to lemon it or get BMW to buy it back. Ask them for a new car in return with the same features minus the CA. Make big waves, without being rude.

I think some of the remaining 2008 on the lots are selling for invoice or less right now, plus 0.9% financing... You might take a good $10k loss off MSRP and like someone else posted, the CA problem will not help with the sale.

Yea, I'm afraid they'll blame it on the film without even troubleshooting. It's huper optic ceramic that is advertised as not affecting electronic signals. That's why I drove 90 miles and paid $400 to have it installed.

What if I remove the film and still have the issue? Then they finally replace a bad sensor in the door handle and it works fine... until after a few car washes when the sensor gets wet again.

I guess I'll give them a chance to look at it before speculating too much.:wink:
