Police Seized Cars in Orange - including several 1-series seen on 1Addicts

I'm in TX, but I saw this article regarding police seizing 17 vehicles during an investigation into a traffic incident in CA. I recognize several cars from posts on here.

Doesn't sound like fun to deal with this PD.

If any of the owners are on here; best of luck in the recovery of your car.

If that's exactly the full story then i smell a lawsuit coming. There's always two sides to a story.

Here's the really scary part. Technically, this is "legal."

It's civil asset forfeiture, and it's been in the news a lot lately as more non-violent, non-criminal people are being victimized by the police.

Basically they can take anything they want, without due process or cause, without a warrant if it's suspected it was involved in any criminal activity. And it's almost impossible to get it back. Many departments even get to keep the money from selling the stuff, which creates a frightening incentive system.

This happens most often with cash, but they can literally take anything from you, and never even charge you with a crime and keep it. Protect yourself, and lawyer up immediately. It's horrifying. And yes, it's definitely a scam.

These guys need to hire an attorney.

In California "such seizures generally cannot be permanent if the owner is not convicted of a crime. But when state and local law enforcement partner with federal agencies in investigations, the federal law applies."

http://www.latimes.com/local/crime/l...714-story.html

If it were me, and if I'd committed no crime (video evidence?) then I'd pursue getting my car back. Only two ways to change the laws: 1) state lawmakers pass a new law, or 2) the courts declare it illegal, misapplied, or against public policy. I sure wouldn't do nothing if I'd done nothing wrong.

Terrifying read
Hopefully they get their cars back. And seeing someone else drive my car that was detained without good reason would infuriate me!

First time I read this I thought it may have been a hoax. Our local paper had an article about one of the guys today: http://www.ocregister.com/articles/c...ce-orange.html

Hey guys! One of the cars that was involved was mine..had it sale before it went and then all of that happened haha. Let's just say the judge was VERY reasonable and understanding and saw that there was absolutely no reason for them to have the cars. So, yeah, my car is for sale as it was before it was taken!

Should consider suing the officer & department. Seems they exceeded their authority.
