135is - Diminished Value Claim
There are lots of DVC posts, but I have a question specific to the 135is.
2013 135is. 47K miles. Flawless. Got rear-ended. No airbag. Approx 1K in damage - bumper was repaired. They made 613 of these cars. I have #178. This may, or may-not, go on a CARFAX. Claim? If so, how much?

depends on your state and the insurance company. I had a similar situation last year where my car had 17,000 miles on it and Geico told me to pound sand. All I could do was to sue them but that was obviously not worth it.

You only chance is to find samples of cars with similar make, model, year & find one with similar damage and demonstrate the diminished value.

Why don't you just hire a diminished value appraiser? There's more to it than that, of course. The insurance company will still attempt to confuse and frustrate you hoping to make you go away. The company in Fort Pierce charges $275 but you can find cheaper online DV reports as well. Your car will probably lose 15% of its pre-accident value because it now has a repair history - whether it gets onto Carfax or not. You sell the car without disclosing prior repairs and the new owner discovers a tape line or over spray you are in for a lawsuit.

When I lived in Kansas, I was able to recover approximately $1k for diminished value when a guy in a big pickup hit my 2009 Honda Pilot. He wasn't paying attention and almost rear-ended the car in front of him when a stoplight turned red. Instead of rear-ending the car in front, he swerved right, directly into the rear driver's tire and quarter panel of my Pilot. No special estimates were required. I just pushed the guy's insurance company with calls and emails until they paid out something.
The dealership then proceeded to do a horrible repair job (3rd party body shop) and ended up selling me a whole new Pilot, but that's a different story. Good luck! -Sam |
