Exclamation Leaking Rear Charge Pipe

I recently picked up a CPO 2008 335i (the car is still stock) and the car has been nothing but a hassel. Anyway, the latest problem with the car has been an engine code P30ff which means that the boost pressure was too low.

So I took it to the dealer thinking that maybe a wastegate was stuck open or possibly a small leak that would be covered under my CPO warranty. As it turns out the rear "air duct" part #13717556550 is leaking and they are denying the warranty on it because they consider it a hose (which it isn't).

So I got the call around 1pm today, thinking they were going to tell me that my car was ready, but instead the SA tells me that it is not a warrantied issue and that the part and labor is going to cost me $1600 dollars. I argued the fact that it is not really a hose because it is a rigid plastic component so it should be covered under warranty and the SM made a call into BMWNA to try to get it covered under "good will."

What I am trying to figure out is, has this happened to anyone else? And if so, how difficult the job is because they want to charge me 9 hours of labor on top of the diagnosis fee of $160. Thanks in Advance.

That attachment is already flawed to begin with and the engineers that designed that connection should be fired.

I'm thinking that it is the connection at the turbo that is leaking and I can probably fix it without even replacing the part. I think that somehow the tension ring must have gotten loose or something.
