Damn e90 has been in the shop for 37 days!

37 days total since I bought it 4.5 months ago! Ugh. Freakin car, driving me nuts. in and out every other week, one thing after another.

Just wanted to vent. Thanks!

what happened? i had the same prob when i first bought my car the turbos had to get replaced and i was very discouraged for like 3 weeks but i got the car back and havent had any problems for about 10k miles.. there is a light at the end of the tunnel!

Call BMW NA about buying your car back. I believe in CA, 30+ consecutive days in the shop is fair game

It hasn't been in for 30 consecutive days. But 37 days total, with a week or a week an a half between visits to service. Average time spent in service is a week and a half.

The engine sputters and the Rpms dip to about 350-400 like its gonna stall (it's an auto) then surges to about 1000 rpm and dips again. They've replaced multiple parts, all new plugs and coils full fuel injector cleaning. Still happening. Started tr repurchase talks two weeks ago. Not sure what BMWNA is gonna do yet. It's so frustrating.

It's a 328i only 41000 miles.

Hire a "lemon" lawyer. That coupled with the lenient california buyback laws and you should be in good shape.

Sorry to hear of your ongoing issues. Hope you can get it resolved soon or get a new car altogether. That's pretty rare to hear for a 328.

Seems its up to the guy in charge of my region, hopefully he has an ounce of common sense and agrees to repurchase the car.

It wouldn't hurt to contact one, but normally the lemon law applies to new cars within a certain time-frame (depending on state).

Most lemon law lawyers will look over your information and let you know if you have a case upfront or not.

I actually did this to a new Camry back in Phoenix. it was a long process but eventually worked out for me. In the end Toyota bought the car back before the court case started, this way it was labeled a buy-back instead of a lemon (so it could be resold without being disclosed as a lemon).

Get rid of the car. You've had it 4.5 mos. and it's been in the shop 37 days, it's a losing proposition. Honestly, I can see a BMW being at the dealer for 7 working days, that's it. S*** or get off the pot is what the service dept. has to do. It's not like their building a car from the ground up.

Apparently, a handful of used/CPO BMW owners have successfully had their cars repurchased. There are a couple of threads about it-goods news for the OP.

In Cali if they sell it with a new Car warranty intact (such as mine) then it is legally considered a new car.

I'm hoping they make the right decision, if they fail to own up to the fact that they are in direct violation of the lemon law statute then I will have to involve an attorney.

BMW is infamous for taking a buyback car, fixing it (hopefully) and then CPO it.

Something Mercedes and Audi dont do.

Well folks, here it is in January and still no repurchase decision. The dealership is replacing everything they can think of on the car in order to fix it, and nothing is working, its been in the shop for 45-50 days total since i bought it 5 months ago, and everyone seems to be dragging their feet.

This is seriously pissing me off...
