The nerve of some people.......
Well my son who just got his licensse 3 weeks ago, took my 328i for a drive to the orthodontist today, and was at a gas station connivence store parking space to get a smoothie. He had his door open and was just sticking his leg out to get out then bam! Some teenage girl ran into the edge lip of his door. She had a huge dent in her lexus, and my door edge only wiped off a tadd of paint that you would never see. I cannot believe the door did not even get damaged. She flew into the parking spot. Luckily my son is ok. She said she called her parents and they said they did not want to call the police, so my son and her exchanged phone numbers and plate numbers. As a new driver, he left and did not call the police because he had no damage done to the car. He made shore it was ok to leave and the girl said it was. So 30 minutes later he gets a call on his cell phone from the police telling him to go back to the scene of the accident. So i went with him. He said there were 2 ladies that worked there he talked to and said they saw that his door was open and saw her fly into the space as she said like a "race track". The police officer herd there stories and they backed up my son completely. As the cop told us, the girls called the police, when they said they were not going to, and said they were in the store when he ran into her car. The wittness'es completely made her liar when they said what really happened. They also said that my son fled the scene, when he made sure it was ok to leave, and the clerks said he made shore it was ok to leave also. So thus girl did not even call her parents as she said she had. This girl is such a b**ch trying to blame my son. Thank god my son was not at fault and she has a giant dent in her car. I am even going to get her insurance to pay for the minor mark on the edge of my door, just because she lied. The officer did not even cite her for lying or reckless driving. This really got me. I cannot stand a little lying brat who tried to blame my son. What do you guys think.

Based on what you said - girl is definitely a b*tch, I would do exactly what you're doing - get her insurance to pay for the mark. It's also worth getting the car checked out, like the door hinges.
Tell your son that he's never allowed to park near other people again. P.S. can't believe you let him take a non-plain water beverage in it either!

what a Sh*tty situation, only thing is won't the insurance money make carfax say the car had an accident? I may be wrong but I would not go that route as it will hurt later with resale. Either way, suck to hear and good luck to you and your son!

People lie about accidents all the time. Has happened to me, to my family, friends, and co-workers.
Always get witnesses if you can. Sometimes the liars will recruit people to pretend to be witnesses and lie for them....... And pretty much everyone has a cell phone camera nowadays. Might not help in a parking lot, but in more serious collision, always get pictures. |

Not classy. Take it to a good shop and have them fix the damage/ spend some shop hours checking the door hinges and panel gaps. She'll appreciate the insurance hike.

I have been reading alot and have been contemplating hard wiring a dashboard cam into my next car..
one that records while the car is on, and then loop records when space fills up.. then I thought maybe that was too extreme and oh what are the odds I will have a situation like this.. but this post has motivated me once again, its a shame how dishonest and just how much of a disgrace some people are. Anyway, as a young driver myself, I am glad your son did the right thing and was able to get through the situation... and also not to downplay.. THAT thank god HE DIDN'T BREAK HIS LEG |

This does not surprise me in the least as I have been in the same situation before. There was a minor (not my fault damage only to the other persons bumper) when I was driving a rental in a parking lot about 7 years back.
After an hour we exchanged info and parted ways as the police did not show. About a month later I got a call from my insurance company with a claim from the other driver with a complete fabrication of the events. From that point on I always get info and then drive to the closest police station and file a report damage or not. Even with little to no damage at least you have record of your side of the event and can prove you were not leaving the scene of an accident later on when the lies fly. If you never get the call later no harm no foul but better safe then sorry. Glad no one was hurt but better for your son to learn early on.... always file a police report so you do not have to defend yourself later without one. In your instance without witnesses you could have had to pay up or at least a higher insurance premium. |

Poorly played by the girl. Even without witnesses your son could've easily provided her name/#(assuming it was real) out of thin air to the police, how would he get said information if he fled the scene?

I was in a minor accident about 10 years back, and the kid had a learner's permit with his brother acting as the co-pilot (or whatever the one with a driver's license is called). We were stopped at a light, leaving an Applebees, when they decided to do a Chinese Fire drill (everyone gets out, runs around the car, pops back in). Well, the light changed to green while they were running around, so I honked my horn. The kids ran back into the car, but the dumb ass driver put it in reverse and BAM!!!! His tow hitch went right through my bumper.
We got out, exchanged info, and my roommate (which they didn't know was my roommate) was in the car behind me, so he acted as the witness. I call the kid the next day (as it was past midnight when it happened) and his dad came on the phone saying that his kid wasn't driving and that he wasn't going to pay for any damages. I told him I had a witness and he said he didn't care. So, I called my insurance (USAA) and gave them the details. They told me to go get an estimate, fax it to them, and they'd mail me a check. They said they would also go after the other guy's insurance. I stopped by the most expensive Body Shop in town, got an estimate, and faxed it to USAA. Not even 2 minutes after I faxed it, I got a call from them stating that they had received my estimate and they would FedEx a check to me, next day! My insurance never went up (it actually went down the next year) and I never heard anything else back from either insurance company (though the Insurance person I spoke to said they would sue the other insurance company if they refused to pay, so they had me and my "witness" sign statements and fax them in). Glad to hear it worked out for your son! |

Typically reckless or even careless driving applies to public roadways and not parking lots. Im not sure why she wasn't charged with some sort of false reports though.
